Proof of Residency
Garner ISD requires families provide proof of residency each year as a final step in the annual
registration process. If you have more than one student attending GISD, you will need to submit proof of
residency for each student individually. Once submitted, your proof of residency will be reviewed by
campus staff to verify it meets one of the requirements listed below. If it is not accepted, you will be
contacted for further information. 


Requirements
Proof of Residency: a water, electric, or natural gas utility statement with the most recent statement
date (within the past 30 days). The statement should show usage, service address, date, and account
owner name.
If you have not lived at your address long enough to receive a utility bill, please provide one of the
following temporarily until a utility bill can be submitted:

  • If you recently signed a lease, a copy showing the date of occupancy, address of residence,signature of lessee and signature of lessor (valid for 30 days until a utility bill is available).
  • If you have recently purchased your home, a copy of the closing papers will suffice until a utility bill is available to reproduce (within 30 days).
  • If you contract to build a home, you must provide a contract or letter from the builder on official letterhead showing a projected closing date during the school year of enrollment, builder’s signature, physical street address and the names of the buyers. 

Please note the enrollment process will not be complete until this documentation has been received.
Students will not be placed on a class list or receive course enrollment information until it has been
provided. Students who are unable to produce documentation to verify residency in the Garner ISD
attendance zone may not be able to attend Garner ISD and will be subject to withdrawal. Residence
requires living in the district and having the present intention to remain there.


Presenting a false record or falsifying records is an offense under Section 37.10, Penal code, and
enrollment of the child under false documents subjects the person to liability for tuition or other
costs. TEC Sec. 25.002(3)(d).

 

Students Living Apart From Guardian
When a student is living within Garner ISD, apart from their legal guardian, the legal guardian must
assign educational rights to the non-guardian with whom the student is living in order for the student to
establish residency with the non-guardian in Garner ISD. The legal guardian and non-guardian being
assigned educational rights must complete the following process:

  • The legal guardian must complete and provide to the campus a Power of Attorney Assigning Educational Rights stating that the student is living with a non-guardian in Garner ISD and that the non-guardian is granted educational rights; and
  • The non-guardian who has been assigned educational rights must provide proof of residency as described above AND a Student Residency Affidavit. The Affidavit must be provided in person to the campus.
  • Requirements for the Power of Attorney Assigning Educational Rights

 Garner ISD accepts a Power of Attorney Assigning Educational Rights in any form provided that it includes the following:

  • names, addresses, phone numbers, and signatures for all legal guardians;
  • a statement that the guardians have chosen to have the student live with the designated non-guardian;
  • a statement that the guardians assign educational rights to the non-guardians and designatethe non-guardian as the primary contact for the school; and
  • notarized signatures of the guardians and copies of the guardians’ drivers’ licenses (out-of-state notarization is acceptable for the Power of Attorney Assigning Educational Rights only.)

Requirements for Student Residency Affidavit*

Garner ISD only accepts Affidavits Affirming Student Residency using the form provided. After the
campus has received a Power of Attorney Assigning Educational Rights, the non-guardian to whom
educational rights have been assigned must complete the Student Residency Affidavit and provide the
Affidavit in person to the campus. The Affidavit must be notarized which can either be done at the
campus, or prior to the form being provided in person.


The Affidavit must be completely filled out by the non-guardian to whom educational rights have been
assigned. When the non-guardian delivers the Affidavit, the non-guardian will be informed that the non-
guardian will now be the primary contact regarding the student.
Upon completion of the Affidavit, a campus staff member may ask to visit the home to ensure that the
student actually lives there.


Each year, the non-guardian must provide a new Affidavit.


If a legal guardian revokes the previously provided Power of Attorney Assigning Educational Rights, then
the Student Residency Affidavit becomes void and the legal guardian must enroll the child in the district
and zone where the legal guardian lives.


Families Living with A Relative or Friend in Garner ISD


If your family is living with a relative or friend within Garner ISD, and you are unable to provide the proof
of residency required above in your name, you may complete a Family Residency Affidavit. However, the
owner or leaseholder of the residence in which you are living must also provide proof of residency as
described above.

Requirements for Family Residency Affidavit

Garner ISD only accepts Family Residency Affidavits using the form provided.

 

The Affidavit must be completely filled out by both the legal guardian of the student and the owner or
leaseholder of the residence in which the family is living. The Affidavit must be notarized which can
either be done at the campus, or prior to the form being provided.


Upon completion of the Affidavit, a campus staff member may ask to visit the residence to ensure that
the family actually lives there.


Each year, the guardian and owner or leaseholder of the residence must provide a new Affidavit.
If your family moves out of the residence, the Affidavit becomes void and the legal guardian must enroll
the child in the district and attendance zone where the legal guardian and student live.

*to most closely meet the guidelines for UIL participation, both the Family Residency
Affidavit and the Student Residency Affidavit must be notarized and filed with the Parker
County Clerk’s Office.
